Unmanned Aircraft/Drone Operator Requirements (Updated)
Part 107 of the Federal Aviation Regulations requires that anyone who operates a small unmanned aircraft/drone for commercial use (weighing more than 0.55 lbs and less than 55 lbs) must obtain a remote pilot airman certificate with a small UAS rating. Certification includes passing an aeronautical test and undergoing a security background check.
The below has been modified to reflect the new rules released on June 21, 2016 for operating small unmanned aircrafts/drones under Part 107 of the Federal Aviation Regulationsfor commercial use. Under this rule, anyone who operates a drone (weighing more than 0.55 lbs. and less than 55 lbs.) must obtain a remote pilot airman certificate with a small UAS rating. Certification includes passing an aeronautical test and undergoing a security background check. In addition, operators must follow FAA registration and operational guidelines.The rules will become effective 60 days after publication in the Federal Register.
Key Drone Operator Items to Confirm
- Operator has a remote pilot airman certification with a small UAS rating or directly supervised by a certificate holder
- UAS complies with existing FAA registration requirements
- Operator is responsible for ensuring the drone is safe (pre-flight inspection) before flying the drone
- Operator is aware of and complies with all Federal, State and Local regulations including privacy guidelines
- Operator is following the FAA operational guidelines for areas of operation and with certain restrictions
- Operator has a flight plan and the UAS is always in the line of sight
- Operation is only during daylight (30 minutes before sunrise or sunset with anti-collision lighting)
- Existence of an Operator Safety & Operational Plan
- Report to the FAA within 10 days of any incident resulting in serious injury or property damage
Contract & Insurance
- Contract includes full defense & hold harmless agreement
- Insurance requirements include Unmanned Aircraft
- Limits are a minimum of $5mm
- Coverage includes Personal Injury (invasion of privacy & trespassing)
- Additional Insured Endorsement includes Owner & Contractor
